State v. Cage

Supreme Court of Louisiana
Mar 9, 1984
446 So. 2d 1214 (La. 1984)

Opinion

No. 84-K-0173.

March 9, 1984.

In Re: Donald Lee Cage, applying for Certiorari, or Writ of Review to the Court of Appeal, First Circuit, No. 83-KA-0802; 19th Judicial District Court, Parish of East Baton Rouge, No. 5-81-963.

Denied.

DIXON, C.J., would grant because the "enhancement" contingency ( 14:95.2) was not charged in a count in the bill. The treatment of this issue in State v. Roussell, 424/226, should probably be overruled.

Reconsideration denied.

CALOGERO, J., would grant the writ.
