Rocco A. Chiarenza, senior assistant state's attorney, in support of the petition.

Emily H. Wagner, assistant public defender, in opposition.

The state's petition for certification to appeal from the Appellate Court, 209 Conn. App. 63, 267 A.3d 256 (AC 43812), is granted, limited to the following issues:

"1. Did the Appellate Court correctly conclude that the trial court lacked inherent common-law authority to modify its judgment of dismissal within four months of the date on which it was rendered?

"2. Did the Appellate Court properly reverse the trial court's decision to open its judgment despite the fact that the judgment of dismissal was predicated on a material misrepresentation made to the trial court?"

ECKER, J., did not participate in the consideration of or decision on this petition.
