DIXON, C.J., would grant a continuance to comply with the requirements of Ake v. Oklahoma, 470 U.S. 68, 105 S.Ct. 1087, 1088, 84 L.Ed. 2d 53 (1985).

CALOGERO, J., would grant the writ.

DENNIS, J., would grant the defendant's request to reopen the sanity hearing on his mental capacity to proceed and to have an independent psychiatrist to examine him and testify in his behalf.
