Opinion

No. 13835.

October 6, 1980. Rehearing Denied December 15, 1980.

Appeal from the Nineteenth Judicial District Court, Parish of East Baton Rouge, Louisiana; William H. Brown, Judge Presiding.

John S. Cage, Jr., Monroe, for plaintiff-appellant, State of Louisiana.

Frank P. Simoneaux, Baton Rouge, for defendant-appellee, L. W. Eaton Const. Co., Inc., et al.

John N. Samaha, Baton Rouge, for exceptor, American Arbitration Assoc.

Before LOTTINGER, EDWARDS and PONDER, JJ.

This appeal from the trial court's refusal to grant a permanent injunction was consolidated by this Court with the appeal from the trial court's refusal to grant a preliminary injunction. We dealt with all the issues involved in No. 13284 on the docket of this Court, 392 So.2d 477.

Therefore, for the reasons announced in Case No. 13284, the decision of the trial court refusing to permanently enjoin arbitration proceedings is affirmed.

AFFIRMED.
