ORDER DENYING IN FORMA PAUPERIS APPLICATION AND DISMISSING CASE

LAUREN KING UNITED STATES DISTRICT JUDGE

The Court, having reviewed the application to proceed in forma pauperis (IFP), the Report and Recommendation of S. Kate Vaughan, United States Magistrate Judge, and the remaining record, does hereby find and ORDER:

(1) The Court adopts the Report and Recommendation;

(2) The IFP application is DENIED and this action is DISMISSED without prejudice due to the failure to comply with the Court's filing fee requirement;

(3) The Clerk is directed to send copies of this Order to the parties and to the Honorable S. Kate Vaughan.
