MEMORANDUM OF DECISION


This is an action brought by the plaintiff insurance company against the defendant law firm seeking a rescission of certain malpractice insurance policies issued by the plaintiff to the defendant. The defendant has been defaulted for failure to appear. This court heard the matter as a hearing in damages on July 12, 2005.

A judgment may enter in favor of the plaintiff finding and ordering that the Lawyers Professional Liability Policies issued by the plaintiff to the defendant for the 1997-1998, 1998-1999, and 1999-2000 policy periods are rescinded.
