Opinion filed March 2, 1942

POOR, § 5county as liable for hospitalization of poor. Where a patient was admitted to a hospital and at the time and thereafter did not have sufficient money or property to pay for his hospitalization, he was in the class of persons entitled to hospitalization under section 24 of the Paupers Act and the county was liable for services rendered after the overseer of the poor was notified that the patient was receiving treatment.

Appeal from Circuit Court of Fayette county; Hon. FRANKLIN R. DOVE, presiding.

Approved in part, but reversed and remanded with directions. Heard in this court at October term, 1941.
