On July 21, 2023, Appellant James Deron Smith, Sr. ("Appellant") filed a Motion for leave to File Extension of Time for Rehearing of the opinion that issued on June 29, 2023. Appellant's Motion for Rehearing was due July 14, 2023. Tex.R.App.P. 49.1. Appellant seeks a forty-five-day extension. Pursuant to Texas Rule of Appellate Procedure 49.9, his motion, which we construe as a Motion for Extension of Time to File a Motion for Rehearing, is timely. Tex.R.App.P. 49.9.

Appellant's motion is granted. His Motion for Rehearing, if any, is due August 28, 2023.

It is so ORDERED.
