Accordingly, IT IS ORDERED that the Defendant's Cross-Motion for Summary Judgment is GRANTED, the Plaintiff's Motion for Summary Judgmentis DENIED, and the Plaintiff's complaint be and is hereby DISMISSED WITH PREJUDICE.
