          STIPULATION OF DISMISSAL OF ACTION

          CAROLYN K. DELANEY, Magistrate Judge.

         Pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii), which provides that an action may be dismissed by a plaintiff without order of Court by filing a stipulation of dismissal signed by all parties who have appeared in the action, Plaintiff Marianne Smith and Defendant Anthony Foxx, Secretary, Department of Transportation, hereby stipulate that this entire action, and any and all remaining claims for relief shall be, and hereby are, dismissed with prejudice.

         The parties shall bear their own fees and costs.

          ORDER

         IT IS SO ORDERED.
