Opinion

Case No. SC03-1969.

May 17, 2005.

Lower Tribunal No. 88-28-CF.

Richard Earl Shere, Jr., a prisoner under sentence of death, seeks rehearing of the denial of his motion for postconviction relief filed pursuant to rule 3.851, Florida Rules of Criminal Procedure. We deny rehearing. This Court has clearly held the Ring does not apply retroactively in Florida. See Johnson v. State, SC03-1042 (Fla. April 28, 2005).

PARIENTE, C.J., and WELLS, ANSTEAD, LEWIS, QUINCE, CANTERO and BELL, JJ., concur.
