Before the Court is appellant/cross-appellee's September 6, 2023, unopposed motion for an extension of time to file its opening brief. By separate unopposed motion, appellees/cross-appellants seek an extension of time to file their cross-appellant's brief.
We GRANT appellant/cross-appellee's motion and ORDER the opening brief filed no later than October 11, 2023. Because our local rules provide that in cross-appeals, an appellee/cross-appellant shall file a combined appellee and cross-appellant's brief, we DENY appellees/cross-appellants' motion as premature. See 5th Tex.App. (Dallas) Loc. R. 5(a). The combined appellee/cross-appellant brief shall be filed within thirty days of the filing of appellant's opening brief. See id. Loc. R. 5(d)(2).
