Curtis Wayne SHANNON, Appellant v. The STATE of Texas, Appellee

From the County Court at Law No. 12, Bexar County, Texas Trial Court No. 540376 Honorable Yolanda T. Huff, Judge Presiding

ORDER

Liza A. Rodriguez, Justice

We previously abated this appeal for the trial court to conduct a hearing to determine whether appellant desires to pursue this appeal and is indigent, and whether court-appointed appellate counsel had abandoned this appeal. The trial court conducted a hearing and determined that appellant desires to pursue this appeal and is indigent. The trial court also permitted appellant's court-appointed counsel, Ms. Staci Krause, to withdraw and stated that new counsel would be appointed. On September 19, 2023, we lifted the abatement and reinstated this appeal and set appellant's brief due on October 23, 2023. To date, appellant's brief has not been filed.

On November 28, 2023, a supplemental clerk's record was filed containing an order showing that on November 27, 2023, Mr. John Lamerson was appointed to represent appellant in this case. Given the delay in appointing new counsel to represent appellant, we extend the time for filing appellant's brief. Appellant's brief is -now due on or before January 3, 2024.
