Sam & Mary Housing Corp. v. Jo/Sal Market Corp.

Court of Appeals of the State of New York
Jun 14, 1984
62 N.Y.2d 941 (N.Y. 1984)

Opinion

Decided June 14, 1984

Appeal dismissed, without costs, by the Court of Appeals sua sponte, upon the ground that no appeal lies as of right under CPLR 5601 (subd [a], par [i]) since the dissent at the Appellate Division, pertaining to a claimed error to which no objection was made, is not on a question of law which would be reviewable in this court ( Guaspari v Gorsky, 29 N.Y.2d 891).
