ORDER

Peter J. Panuthos Special Trial Judge.

This case is calendared for trial at the Court's New York City, New York trial session commencing October 28, 2024. By Order served July 24, 2024, the Court directed petitioner to file a response to respondent's Motion to Dismiss on Ground of Mootness, filed July 16, 2024. The response was due August 21, 2024. As of the date of serving this Order, the Court has not received a response. Respondent's counsel has further indicated that petitioner's counsel has not responded to attempted communications. The Tax Court Rules of Practice and Procedure and the Standing Pretrial Order require responses to the Court and communication among the parties.

Premises considered, it is hereby

ORDERED that, on or before September 16, 2024, petitioner shall (1) respond to the Court's July 24, 2024 Order and (2) indicate that petitioner has communicated his views with respondent's counsel.
