ORDER


After making an independent review of the pleadings, files and records in this case, and the findings and recommendation of the United States Magistrate Judge filed on April 17, 2001, the court concludes that the findings and conclusions of the United States Magistrate Judge are correct. Plaintiff filed no objections. The findings and recommendation of the United States Magistrate Judge are hereby accepted by the court. Plaintiff's complaint is dismissed with prejudice as frivolous, pursuant to 28 U.S.C. § 1915(e)(2), 1915A(b).

It is so ordered.
