Counsel for appellant having moved for leave to withdraw or discontinue the appeal taken herein from an order of the Family Court, Erie County, entered July 19, 2022, or, in the alternative, for an extension of time to perfect, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is hereby ORDERED that the motion insofar as it seeks leave to withdraw or discontinue the appeal is denied (see generally Hummel v Cilici, LLC, 203 A.D.3d 1591, 1593 [4th Dept 2022]), and
It is further ORDERED that the motion insofar as it seeks an extension of time to perfect is granted, the time to perfect the appeal is extended to September 18, 2023, and, in the event of failure to so perfect, the appeal is hereby dismissed without further order.
