Opinion

CR-92-0896.

October 22, 1993.

Appeal from Mobile Circuit Court; Robert Kendall, Judge.

Cindy Powell, Mobile, for appellant.

James H. Evans, Atty. Gen., and Jean Brown, Asst. Atty. Gen., for appellee.

The appellant, Edward Louis "Buddy" Robinson, appeals a conviction and sentence that were set aside because the trial court did not have jurisdiction to conduct proceedings in the case while it was pending on appeal. Robinson v. State, 629 So.2d 3 (Ala.Cr.App. 1993). Because the conviction and sentence were set aside, this appeal is moot, and it is hereby dismissed.

APPEAL DISMISSED.

All the Judges concur.
