2. Petitioner's Amended Petition for Writ of Habeas Corpus (Doc. No. 3) is DENIED without prejudice; and
3. Petitioner's Motion for Relief Pending Evidentiary Hearing (Doc. No. 5) is DENIED AS MOOT.
