AMENDED ORDER

The Court orders that the motion for sanctions for vexatious proceedings is GRANTED TO THE EXTENT that we determine this appeal was taken without any reasonable basis for belief that there was a meritorious issue to be determined on appeal. MCR 7.216(C)(1)(a). We REMAND this case to the trial court to determine and award in favor of appellee and against appellant and/or appellant's counsel actual damages and expenses, including reasonable attorney fees and costs, incurred by appellee due to the bringing of this vexatious appeal. MCR 7.216(C)(2).

We do not retain jurisdiction.
