ORDER


The petition for a writ of habeas corpus is denied for the reasons set forth in the thorough report and recommendation of Magistrate Judge Michael H. Dolinger, dated August 26, 2005, to which no objections have been filed. A certificate of appealability is denied, and the Court certifies that any appeal herefrom would not be taken in good faith within the meaning of 28 U.S.C. § 1915(a)(3).
