ORDER

This matter is before the court on Appellant Commissioner of Social Security's Consent Motion to Voluntarily Dismiss Appeal. The motion requests voluntary dismissal pursuant to Fed. R. App. P. 42(b) as consented to by Appellee, and states that the parties agree that each side will bear its own costs of the appeal.

Upon consideration, the motion for voluntary dismissal is granted and this appeal is dismissed. See Fed. R. App. P. 42(b); 10th Cir. R. 27.5(A)(9). Each party will bear its own costs of the appeal.

A copy of this order shall stand as and for the mandate of the court.
