R. Place Rest. Corp. v. Regina Costa

Appellate Court of Connecticut
Feb 22, 1988
537 A.2d 547 (Conn. App. Ct. 1988)

Opinion

(5783) (5784)

Argued February 3, 1988

Decision released February 22, 1988

Action, in the first case, to enjoin the defendant from, inter alia, ejecting the plaintiff from possession of certain leased premises, and action, in the second case, for summary process, brought to the Superior Court in the judicial district of Windham, geographical area judgment in the first case, in part, for the plaintiff, from which the defendant appealed to this court, and judgment in the second case for the defendant, from which the plaintiffs appealed to this court. Appeals dismissed.

John R. Williams, for the appellants (defendant in the first case, plaintiffs in the second case).

Raymond F. Parlato, for the appellee (plaintiff in the first case, defendant in the second case).

Both of these appeals concern an action of summary process. At oral argument, it was revealed that the tenant is no longer in possession of the premises. Accordingly, the matters have been rendered moot. See Yankee Sailing Co. v. Yankee Harbor Marina, Inc., 5 Conn. App. 153, 157, 497 A.2d 93 (1985).
