Appeal, No. 258, Jan. T., 1971, from decree of Court of Common Pleas, Trial Division, of Philadelphia, Oct. T., 1970, No. 4119, in case of R. M. Shoemaker Co. v. Jack W. Blumenfeld, Jack W. Blumenfeld Co., Jane Development Corp. Appeal quashed.

Equity. Before BRADLEY, J.

Petition to strike lis pendens and preliminary objections by defendants granted, and action transferred to law side of court. Plaintiff appealed.

Victor Wright, with him Fox, Rothschild, O'Brien Frankel, for appellant.

Milton S. Lazaroff, with him Techner, Rubin and Shapiro, for appellees.


This appeal being from an interlocutory order not made appealable by statute, the appeal is quashed. Appellant to pay costs.

Mr. Chief Justice BELL took no part in the consideration or decision of this case.
