On appeal from an order in bankruptcy of the District Court for the Southern District of New York denying a motion of the appellant, Principale, for an order permitting him "equity rights and participation in the assets of the surviving company General Public Utilities Corporation under Rule 60 of the Federal Rules of Civil Procedure, 28 U.S.C.A., on 2 (newly discovered evidence) or 3 (fraud) in paragraph (b) of Rule 60."
