Motion for judicial notice granted

The judicial notice request of real party in interest, California Department of Forestry and Fire Protection (CalFire), filed on July 23, 2020, is granted as to Exhibits A, B, C, and D, and denied as to Exhibit E. As to Exhibit F, CalFire provides a photocopy of a published work that is no longer in print, A.K. Wylie & S.M. Schick, A Study of Fire Liability Law (1957). Because no request for judicial notice is necessary for published works, (Quelimane Co. v. Stewart Title Guaranty Co. (1998) 19 Cal.4th 26, 45, fn. 9), CalFire provides this document merely for the convenience of the court and the parties. “We therefore consider the request for judicial notice as a citation to those materials that are published.” (Ibid.)

Amicus Curiae Sierra Pacific Industries' judicial notice request, filed on November 10, 2020, is granted.
