CAROLINA PORTURAS, Appellant v. JEFF ANGLOBALDO, Appellee

On Appeal from the County Court at Law No. 4 Collin County, Texas Trial Court Cause No. 004-01546-2023

ORDER

KEN MOLBERG, JUSTICE

This appeal was filed following the trial court's oral ruling denying appellant's special appearance. Because the deadline for filing a notice of appeal runs from the date the final judgment or appealable order is signed, we questioned our jurisdiction over the appeal. See Tex. R. App. P. 26.1; Farmer v. Ben E. Keith Co., 907 S.W.2d 495, 496 (Tex. 1995) (per curiam).

In jurisdictional briefing filed at our request, appellant asks we abate the appeal until the trial court signs an order memorializing its ruling. We GRANT the request TO THE EXTENT we ORDER appellant to file, no later than December 20, 2023, a status report, or if an order has been signed, a supplemental clerk's record containing a copy of the order. We caution appellant that the appeal is subject to dismissal for want of jurisdiction if an order is not signed. See Tex. R. App. P. 42.3(a).

We DIRECT the Clerk of the Court to send a copy of this order to the Honorable David D. Rippel, Presiding Judge of County Court at Law No. 4; Collin County Clerk Stacey Kemp; and the parties.

We ABATE the appeal pending the filing of the status report or supplemental record. The appeal shall be reinstated no later than December 29, 2023.
