Planning Research Co. v. Shy

District Court of Appeal of Florida, First District
Feb 20, 1980
379 So. 2d 1047 (Fla. Dist. Ct. App. 1980)

Opinion

No. QQ-299.

February 20, 1980.

Petition for review from the Judge of Industrial Claims, John Paul Jones.

Richard H. Weisberg, of Cooper Rissman, P.A., Orlando, for appellants.

Frank Henry Molica, P.A., Merritt Island, for appellee.

AFFIRMED.

This is a case of first impression which squarely poses the issue of whether, under appropriate circumstances, treatment at a pain clinic constitutes remedial treatment pursuant to § 440.13(1), Florida Statutes. We hold that it does. Cf. Goldsmith v. Buena Vista Construction Co., 304 So.2d 110 (Fla. 1974).

ERVIN, SHIVERS and SHAW, JJ., concur.
