Appeal from the Supreme Court, New York County (Irma Vidal Santaella, J.).


Age limits for the appointment of police officers are a recognized exception to the general prohibition of age discrimination by entities governed by the Civil Service Law, and have been expressly sanctioned (Knapp v Monroe County Civ. Serv. Commn., 77 A.D.2d 817, appeal dismissed 51 N.Y.2d 877).
