This case is currently calendared on the Court's Cleveland, Ohio trial session, scheduled to begin October 2, 2023.
Currently pending before the Court are the Commissioner's (1) motion for continuance filed September 1, 2023, and (2) motion to dismiss for lack of jurisdiction filed September 11, 2023. On September 12, 2023, the Court issued an Order directing petitioners Shaun J. Peoples and Chase L. Peoples to file an objection to the motion to dismiss for lack of jurisdiction by September 25, 2023. The Peoples have not filed anything with the Court. Upon due consideration, it is
ORDERED that the Commissioner's above-referenced motions are set for hearing at10:00 a.m. on Monday, October 2, 2023, during the call of the calendar of the Court's Cleveland, Ohio trial session. The Peoples are advised that failure to appear at the hearing may result in the Court granting the Commissioner's motion to dismiss for lack of jurisdiction, which would end this case (absent further Court action).
