147 Cal.App.4th 1374a __ Cal.Rptr.3d __ THE PEOPLE, Plaintiff and Respondent, v. RICHARD E. WILMSHURST, Defendant and Appellant. C050103 California Court of Appeal, Third District, Calaveras February 6, 2007

[CERTIFIED FOR PARTIAL PUBLICATION ]

Pursuant to California Rules of Court, rule 976.1, this opinion is certified for publication with the exception of sections IV, V, VI, VII and VIII of the Discussion.

THE COURT:

It is ordered that the opinion filed in this case on January 8, 2007 (146 Cal.App.4th 621; 53 Cal.Rptr.3d 136), be modified as follows:

In the fourth sentence of the first full paragraph on page 5 of the opinion [146 Cal.App.4th 626, advance report, 2d full par., line 8], the words "three submachine guns" shall be deleted and replaced with the words "a machine gun and two assault rifles" so that the sentence reads:

“Under the bed and in a wooden footlocker were a machine gun and two assault rifles; seven other illegal assault weapons were in the storage area.”

This modification does not change the judgment.

Appellant’s petition for rehearing is denied.
