Defendant having moved for an extension of the time to file and serve an affidavit in support of an application pursuant to CPL 460.15 seeking permission to appeal the order of Supreme Court, Monroe County dated June 1, 2012,

Now, upon reading and filing the affidavit of Michael C. Williams sworn to August 9, 2012, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is further ORDERED that the motion is granted to the extent that the Clerk is directed to accept the affidavit submitted to this Court on August 13, 2012 for filing.
