PEOPLE of the State of Michigan, Plaintiff–Appellee, v. Demiestro Terrance WATSON, Defendant–Appellant.


Order

On order of the Court, the application for leave to appeal the December 9, 2016 order of the Court of Appeals is considered and, pursuant to MCR 7.305(H)(1), in lieu of granting leave to appeal, we REMAND this case to the Court of Appeals for consideration as on leave granted. The court shall address the defendant's argument that the trial court's alleged failure to advise him of the maximum possible prison sentence for the offense of assault with intent to commit murder rendered his plea involuntary and entitled him to the remedy provided by MCR 6.310(C). See People v. Brown , 492 Mich. 684 (2012). The motion to add an issue is DENIED, without prejudice to defendant's assertion of the motion on remand.

Wilder, J., did not participate because he was on the Court of Appeals panel.
