Court of Appeals of the State of New York
Feb 26, 1970
26 N.Y.2d 845 (N.Y. 1970)

Opinion

Argued February 17, 1970

Decided February 26, 1970

Appeal from the Appellate Division of the Supreme Court in the Second Judicial Department, MICHAEL KERN, J.

Eugene Gold, District Attorney ( Stanley M. Meyer of counsel), for appellant.

Maurice Brill for Horace Thomas, respondent.

Patrick M. Wall for Lawrence Walker, respondent.

Appeal dismissed unless the Appellate Division shall grant a motion, made within 10 days, to resettle its order of reversal and amend its memorandum decision so as to show unequivocally that the judgments of the Supreme Court, Kings County, were reversed on the law alone (see People v. Rossi, 11 N.Y.2d 787).
