ORDER MODIFYING OPINION AND DENYING REHEARING, NO CHANGE IN JUDGMENT

THE COURT:

It is ordered that the opinion filed herein on April 19, 2005 (128 Cal.App.4th 733;___Cal.Rptr.3d___), be modified as follows:

On page 67 [128 Cal.App.4th 751, advance report], in the paragraph that begins “This interpretation,” delete the second sentence and insert in its place the following sentence:

Included in those designated felonies is one that is punishable only by a term of life in prison without possibility of parole: kidnapping for ransom in which the victim “suffers death or bodily harm, or is intentionally confined in a manner which exposes [the victim] to a substantial likelihood of death” (§ 209, subd. (a)).

This modification does not change the judgment.

Defendant Tran’s petition for rehearing is denied.
