People of Michigan v. Daniel Thomas Vanderklok

LC No. 23-001441-FH

Michael J. Riordan, Presiding Judge, Christopher M. Murray, Allie Greenleaf Maldonado, Judges

ORDER

In lieu of granting the application for leave to appeal, this case is REMANDED to the trial court for resentencing because, as conceded by the prosecution, the trial court erred in scoring points for Offense Variable (OV) 13 of the sentencing guidelines. MCR 7.205(E)(2). On remand, the trial court shall revise the scoring of the sentencing guidelines to score zero points for OV 13 and resentence defendant in light of that corrected scoring. In all other respects the application is DENIED for lack of merit in the grounds presented.

We do not retain jurisdiction.
