OPINION

THE COURT

On November 13, 2002, appellant Michael Edward Tilton pled nolo contendere to one count of continuous sexual abuse of a child under age 14 (Pen. Code, § 288.5, subd. (a)). The plea agreement did not include a cap on Tiltons prison term. The court sentenced Tilton to prison for the upper term of 16 years. The court granted Tilton applicable custody credits, ordered him to pay a restitution fine, and ordered him to register as sex offender.

Tiltons appointed appellate counsel has filed an opening brief which summarizes the pertinent facts, raises no issues, and requests this court independently to review the record. (People v. Wende (1979) 25 Cal.3d 436.) The opening brief also includes the declaration of appellate counsel indicating that Tilton was advised he could file his own brief with this court. By letter of March 17, 2003, we invited Tilton to submit additional briefing. To date, he has not done so.

After independent review of the record, we have concluded no reasonably arguable legal or factual argument exists.
