People v. Thomas

Appellate Division of the Supreme Court of New York, Fourth Department
Mar 17, 1995
213 A.D.2d 1078 (N.Y. App. Div. 1995)

Opinion

March 17, 1995

Appeal from the Genesee County Court, Morton, J.

Present — Green, J.P., Fallon, Wesley, Callahan and Balio, JJ.

Judgment unanimously affirmed. Memorandum: The record does not support the contention that the sentencing court should have granted defendant youthful offender status, and we decline to disturb the court's discretionary determination (see, People v Pappas, 198 A.D.2d 918). Defendant's sentence is neither harsh nor excessive.
