Summary
In People v Strafford (164 A.D.2d 898) the County Court, in accordance with its own policy, required the defendant to waive his right to appeal in exchange for the sentence commitment and this court upheld the waiver and dismissed the defendant's appeal (see, People v Strafford, supra; see also, People v Williams, 36 N.Y.2d 829, cert denied 423 U.S. 873).
Summary of this case from People v. BrattonOpinion
August 13, 1990
Appeal from the County Court, Nassau County (Mackston, J.).
Ordered that the appeal is dismissed.
A review of the record discloses that the defendant waived his right to appeal as part of his plea agreement. Because we find that this waiver was made freely, knowingly and voluntarily, the defendant's appeal must be dismissed (see, People v Seaberg, 74 N.Y.2d 1). Bracken, J.P., Kunzeman, Eiber and O'Brien, JJ., concur.
