          OPINION

          Petition for review granted; transferred to Court of Appeal, Third Appellate District.

          Respondent’s petition for review is granted.

         The matter is transferred to the Court of Appeal, Third Appellate District, with directions to vacate its decision and reconsider the cause in light of People v. Chance (2008) 44 Cal.4th 1164, 81 Cal.Rptr.3d 723, 189 P.3d 971. (Cal. Rules of Court, rule 8.528(d).)
