Appellate Division of the Supreme Court of New York, Second Department
Aug 22, 2005
21 A.D.3d 570 (N.Y. App. Div. 2005)

Opinion

2003-02715.

August 22, 2005.

Appeal by the defendant from a judgment of the Supreme Court, Westchester County (Rosato, J.), rendered February 27, 2003, convicting him of manslaughter in the first degree, upon his plea of guilty, and imposing sentence.

Ethel P. Ross, Cross River, N.Y., for appellant.

Jeanine Pirro, District Attorney, White Plains, N.Y. (Kiernan Thomas Byrne and Valerie A. Livingston of counsel), for respondent.

Before: Adams, J.P., Goldstein, Smith, Rivera and Lifson, JJ., concur.

Ordered that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted ( see Anders v. California, 386 US 738; People v. Paige, 54 AD2d 631; cf. People v. Gonzalez, 47 NY2d 606).
