People v. Robinson

Appellate Division of the Supreme Court of New York, Second Department
Sep 15, 1997
242 A.D.2d 593 (N.Y. App. Div. 1997)

Opinion

September 15, 1997

Appeal from County Court, Suffolk County (Cotter, J.).

Ordered that the judgments are affirmed.

Appellate review of the issues raised by the defendant concerning the admissibility of his confession and the factual allocution at the pleas is precluded by virtue of his valid waiver of the right to appeal ( see, People v. Callahan, 80 N.Y.2d 273; People v. Kirby, 216 A.D.2d 586). The defendant's remaining argument is without merit ( see, People v. Frederick, 45 N.Y.2d 520, 527; People v. Anderson, 203 A.D.2d 373).

Mangano, P.J., Copertino, Altman and Goldstein, JJ., concur.
