Appeal by the defendant from an amended judgment of the County Court, Orange County (De Rosa, J.), rendered October 14, 2015, revoking a sentence of probation previously imposed by the same court (Berry, J.), upon a finding that he had violated a condition thereof, upon his admission, and imposing a sentence of imprisonment upon his previous conviction of aggravated unlicensed operation of a motor vehicle in the first degree.

ORDERED that the amended judgment is affirmed.

Contrary to the People's contention, the defendant did not knowingly, voluntarily, and intelligently waive his right to appeal (see People v. Bradshaw, 18 N.Y.3d 257, 265, 938 N.Y.S.2d 254, 961 N.E.2d 645 ; People v. Lopez, 6 N.Y.3d 248, 256, 811 N.Y.S.2d 623, 844 N.E.2d 1145 ; People v. Finnegan, 112 A.D.3d 847, 976 N.Y.S.2d 231 ; People v. Gil, 109 A.D.3d 484, 485, 970 N.Y.S.2d 88 ). Moreover, even a valid waiver of the right to appeal does not preclude this Court from reviewing the defendant's contention that the County Court violated his rights under the Due Process Clause of the New York Constitution (see People v. Callahan, 80 N.Y.2d 273, 280, 590 N.Y.S.2d 46, 604 N.E.2d 108 ; People v. Seaberg, 74 N.Y.2d 1, 9, 543 N.Y.S.2d 968, 541 N.E.2d 1022 ; People v. Cesar, 131 A.D.3d 223, 226, 14 N.Y.S.3d 100 ).

However, as the People correctly contend, the defendant failed to preserve for appellate review his claim that the County Court violated his constitutional right to due process (see People v. Russo, 85 N.Y.2d 872, 874, 626 N.Y.S.2d 51, 649 N.E.2d 1195 ; People v. Cesar, 131 A.D.3d at 227, 14 N.Y.S.3d 100 ; People v. Filer, 97 A.D.3d 1095, 1097, 947 N.Y.S.2d 743 ; People v. Corker, 67 A.D.3d 926, 926–927, 888 N.Y.S.2d 418 ). In any event, the defendant's contention is without merit.
