ORDER MODIFYING OPINION; NO CHANGE IN JUDGMENT

OPINION

SILLS, P. J.

The opinion filed in this case on October 26, 2004 (124 Cal.App.4th 216; 21 Cal.Rptr.3d 13), and ordered published on November 19, 2004, is hereby modified as follows:

On page 5 [124 Cal.App.4th 221], in the second sentence of the first full paragraph, the quotation should have internal quotation marks as well as initial quotation marks. Also, the third sentence-- a parenthetical citation—of that same paragraph should be replaced with the following: “(People v. Leyba (1981) 29 Cal.3d 591, 597 [174 Cal.Rptr. 867].)”

This modification does not effect a change in the judgment.
