Appeal by defendant from a judgment of the County Court, Nassau County, rendered January 24, 1975, convicting him of robbery in the first degree, upon a jury verdict, and imposing sentence. Judgment affirmed (People v Felder, 39 A.D.2d 373, affd 32 N.Y.2d 747, app dsmd sub nom Felder v New York, 414 U.S. 948). Mullaney v Wilbur ( 421 U.S. 684) is inapplicable on the facts of the instant case. Hopkins, Acting P.J., Cohalan, Christ, Munder and Shapiro, JJ., concur.
