People v. Mass

Appellate Division of the Supreme Court of New York, Second Department
Apr 29, 1996
226 A.D.2d 745 (N.Y. App. Div. 1996)

Opinion

April 29, 1996

Appeal from the Supreme Court, Kings County (Curci, J.).

Ordered that the sentence is affirmed.

The defendant effectively waived appellate review of the length of her sentence as part of her plea bargain ( see, People v Callahan, 80 N.Y.2d 273; People v. Seaberg, 74 N.Y.2d 1).

In any event, we have examined the defendant's contention that the sentence is excessive and find it to be without merit ( see, People v. Suitte, 90 A.D.2d 80). Mangano, P.J., Bracken, Miller, Copertino and Hart, JJ., concur.
