Summary Dispositions October 8, 1996:

In lieu of granting leave to appeal, the judgment of the Court of Appeals is affirmed on the ground that the defendant did not have a possessory interest in the area between the sidewalk and roadway sufficient to come within the exception stated in the statute. MCL 750.227; MSA 28.424. MCR 7.302(F)(1). Reported below: 210 Mich. App. 455.


We would grant leave to appeal.
