People v. Jenkins

Appellate Division of the Supreme Court of New York, Second Department
Mar 17, 1986
118 A.D.2d 731 (N.Y. App. Div. 1986)

Opinion

March 17, 1986

Appeal from the Supreme Court, Kings County (Vinik, J.).

Judgment affirmed.

As part of the plea agreement, the defendant validly waived his right to review on appeal the denial of his motion to suppress physical evidence, and, accordingly, that issue is not properly before this court (People v. Williams, 36 N.Y.2d 829, cert denied 423 U.S. 873; People v. Esajerre, 35 N.Y.2d 463). Mangano, J.P., Thompson, Brown and Eiber, JJ., concur.
