Appeal from a judgment of the District Court of Suffolk County, Second District (C. Steven Hackeling, J.), rendered April 2, 2008. The judgment, after a nonjury trial, found defendant not guilty of violating section 213-77 (A) of the Town of Babylon Code.

Appeal dismissed.

PRESENT: RUDOLPH, P.J., MOLIA and SCHEINKMAN, JJ.


No appeal lies from a judgment in favor of a defendant in a criminal case upon a finding that defendant's guilt was not established beyond a reasonable doubt ( People v Pantano, 46 AD2d 914; People v Schaum , 10 Misc 3d 94 [App Term, 9th 10th Jud Dists 2005]).
