DECISION AND ORDER ON MOTION

Motion for permission to proceed on appeal as a poor person, for assignment of counsel and for further relief.

Upon the papers filed in support of the motion, and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted only to the extent that counsel is assigned for the purpose of moving for an enlargement of time pursuant to section 800.14 (c), (j) of this Court's Rules of Practice, and it is further

ORDERED that Paul R. Corradini, Esq., P.O. Box 1224, Elmira, NY 14902-1224, (607) 731-2039, is assigned to represent appellant for that purpose, pursuant to County Law § 722, and it is further

ORDERED that in the event the motion for an enlargement of time is denied, the appeal will be dismissed.
